OVERVIEW

This website is operated by WAXZONE LLC, doing business as MOSA Consignments (“MOSA Consignments,” “we,” “us,” or “our”). Throughout this website, the terms “you” and “your” refer to customers, visitors, and other users.

By visiting our website, purchasing a product, or otherwise using our services, you agree to these Terms of Service and the policies incorporated into them, including our Shipping Policy, Refund Policy, and Privacy Policy.

If you do not agree to these terms, you should not use this website or purchase products from us.

  1. ELIGIBILITY

You must be legally capable of entering into a binding contract to place an order. If you are under the age of majority in your state, you may use this website only with the involvement and permission of a parent or legal guardian.

  1. PRODUCTS AND LISTINGS

We sell sports cards and other collectible items. Unless a listing clearly states otherwise, the photographs show the specific card or collectible the customer will receive.

We make reasonable efforts to describe each item accurately and disclose visible imperfections. Colors, surface details, and other characteristics may appear differently depending on lighting, photography, screen settings, or display equipment.

Product availability is limited. Placing an item in a shopping cart does not reserve it or guarantee availability.

  1. RAW CARD CONDITION AND GRADING

Raw cards are not professionally graded. Any stated condition represents our good-faith visual assessment and is not a guarantee that a card will receive any particular grade from PSA, SGC, Beckett, CGC, or any other grading company.

Customers should carefully review all listing photographs and disclosed imperfections before purchasing. Manufacturing variations and imperfections may include centering differences, print lines, surface marks, edge wear, corner wear, or similar characteristics.

Third-party grading decisions are subjective and are outside our control. We are not responsible for the grade, authentication decision, or label assigned by a third-party grading company after purchase.

  1. PRICES AND PAYMENT

All prices are listed in United States dollars unless otherwise stated. Applicable taxes and shipping charges, if any, are displayed during checkout.

Payment must be successfully authorized before an order is processed. We may correct pricing, description, or inventory errors before fulfillment. If an order is canceled because of an error, unavailable inventory, suspected fraud, or another legitimate reason, any collected payment will be refunded to the original payment method.

  1. ORDER ACCEPTANCE

An order confirmation acknowledges that we received the order; it does not guarantee final acceptance or fulfillment.

We reserve the right to refuse or cancel an order when reasonably necessary, including because of inventory errors, payment problems, suspected fraud, prohibited resale activity, technical errors, or violations of these Terms.

We will not cancel or refuse orders for unlawful discriminatory reasons.

  1. SHIPPING

We currently ship only within the United States. Available services, processing times, tracking practices, insurance requirements, signature requirements, and procedures for delayed, lost, or damaged shipments are described in our Shipping Policy.

Customers are responsible for providing a complete and accurate delivery address. Please contact us immediately if an address correction is needed. We cannot guarantee that an address can be changed after fulfillment begins.

  1. RETURNS AND REFUNDS

All trading-card and collectible sales are final except as stated in our Refund Policy or as required by applicable law.

Our final-sale policy does not eliminate remedies for an incorrect item, an item materially different from its listing, damage in transit, an order lost before confirmed delivery, or another circumstance for which applicable law requires a remedy.

Please review our Refund Policy before placing an order.

  1. CANCELLATIONS

Cancellation requests must be submitted before an order enters fulfillment. We will attempt to honor timely requests, but cancellation is not guaranteed once processing has begun.

If we cannot ship within the promised processing timeframe, we will notify the customer and provide the option to accept the delay or cancel the unshipped order for a full refund.

  1. ACCURACY OF INFORMATION

We make reasonable efforts to ensure that product descriptions, photographs, prices, and other information are accurate. However, typographical errors, technical errors, or omissions may occasionally occur.

We may correct errors and update information before an order is fulfilled. Nothing in this section limits a customer’s rights when an item received is materially different from its listing.

  1. PROHIBITED USES

You may not use this website or its content:

• For unlawful, fraudulent, abusive, or deceptive purposes.
• To interfere with the website’s security or operation.
• To transmit malicious software or harmful code.
• To collect personal information about others without authorization.
• To impersonate another person or misrepresent your identity.
• To infringe intellectual-property or privacy rights.
• To place orders using unauthorized payment information.

We may restrict access or cancel affected orders when we reasonably believe these restrictions have been violated.

  1. INTELLECTUAL PROPERTY

Unless otherwise stated, the website’s original text, branding, layout, graphics, and other original content are owned by or licensed to WAXZONE LLC and are protected by applicable intellectual-property laws.

Product names, athlete names, team names, league names, manufacturers’ names, logos, and other third-party marks belong to their respective owners. Their appearance identifies or describes collectible products and does not imply sponsorship, endorsement, or affiliation.

  1. THIRD-PARTY SERVICES

Our store is hosted by Shopify. Payment processors, shipping carriers, analytics providers, and other third parties may provide portions of the services used to operate the store.

Your use of third-party services may also be subject to those providers’ terms and privacy practices. We are not responsible for third-party websites or services that we do not control, except to the extent required by applicable law.

  1. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, this website and its services are provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted, secure, or error-free.

This disclaimer does not exclude warranties, protections, or remedies that cannot legally be waived.

  1. LIMITATION OF LIABILITY

To the fullest extent permitted by law, WAXZONE LLC and MOSA Consignments will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the website or products purchased through it.

Nothing in these Terms limits liability or consumer rights that cannot legally be limited or excluded.

  1. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless WAXZONE LLC and MOSA Consignments from third-party claims resulting from your unlawful use of the website, violation of these Terms, or infringement of another party’s rights.

  1. SEVERABILITY

If any provision of these Terms is found unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

  1. NO WAIVER

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

  1. GOVERNING LAW

These Terms are governed by the laws of the State of Illinois and applicable federal law, without regard to conflict-of-law principles.

Nothing in this section prevents a customer from exercising rights available under mandatory consumer-protection laws.

  1. CHANGES TO THESE TERMS

We may update these Terms to reflect changes to our operations, services, or legal obligations. Revised Terms will be posted on this website with an updated revision date.

Changes will apply prospectively and will not reduce rights relating to an order placed before the revised Terms became effective.
